SPD Releases Statement
The Salina Police Department has concluded its investigation into an incident that occurred at South Middle School on September 6, 2024, involving a 13-year-old male student and a 39-year-old male teacher.
The investigation was initiated following reports that the student was bench pressing in the school’s weight room when, after completing the exercise, the teacher allegedly sat on the student. Shortly thereafter, the student lost consciousness and rolled off the bench, striking his head and sustaining a cut.
After conducting interviews with all individuals present during the incident, the case was forwarded to the Salina Municipal Court for review. The court then requested that the Saline County Attorney’s Office evaluate the case for potential prosecution.
Upon review, the Saline County Attorney’s Office declined to pursue criminal charges. According to witness statements, the majority felt the incident was playful in nature and did not meet the legal threshold for criminal intent. Based on these opinions, the County Attorney determined that there was insufficient evidence to establish criminal intent.
