Plus Power Appeal Continuation Fails to Receive Motion at County Commission Meeting

Plus Power Appeal Continuation Fails to Receive Motion at County Commission Meeting

In Tuesday's County Commission Meeting, Commissioners addressed the appeal from Mountain Peak Energy Storage (operating as Plus Power) seeking a continuation of their appeal regarding the Planning Commission's decision on September 26, which denied their request to establish a battery energy storage facility in the County. The appeal aimed to reschedule the County Commission's consideration from November 14 to a date in February 2024.

Given the procedural nature of this request and its implications for due process, Staff opted not to provide a specific recommendation. However, the County Counselor recommended granting the continuance, highlighting that the Planning Commission had convened on October 24, 2023, and outlined the grounds for denial. Granting a continuance would afford the appealing party ample time to review these findings and adequately prepare for the appeal.

During the meeting, a motion was proposed to extend the appeal until December 19, 2023, but it failed to receive a second. Subsequently, no further motion was made, resulting in the failure of the action item. Commissioner Vidricksen was not present.
